Psychisch kranke Kinder und Jugendliche als Waisenkinder des Wirtschaftlichkeitsgebots?

Fehlende Anreize für die Pharmaindustrie, Arzneimittelstudien auch im Kindes- und Jugendalter durchzuführen, haben in Deutschland zu einer Unterversorgung mit Arz- neimitteln in der Pädiatrie und der Kinder- und Jugendpsychiatrie geführt. Die Praxis hilft sich mit der Anwendung von Arzneimitteln, die für Erwachsene zugelassen sind; Solcher "Off-Label-Use" ist für viele Indikationen zum medizinischern Standard ge- worden und damit in haftungsrechtlicher Hinsicht vom Arzt geschuldet. Wenn das Wirtschaftlichkeitsgebot in der gesetzlichen Krankenversicherung eine Verordnung nicht geprüfter Arzneimittel verbietet, kann Off-Label-Use hiervon nicht erfaßt sein, da andernfalls Minderjährige verfassungswidrig benachteiligt würden. Dank der euro- päischen Orphan-Drug-Verordnung kann langfristig eine Verbesserung der Versorgung minderjähriger Patienten mit Arzneimitteln für das Kindes- und Jugendalter erwartet werden. Bis dahin ist es aber ethisch wie rechtlich unzulässig, Minderjährigen durch sozialrechtliche Verordnungsbeschränkungen, insbesondere eine Positivliste, eine Standardbehandlung vorzuenthalten, auch wenn der medizinische Standard die Ver- ordnung eines für Minderjährige nicht zugelassenen Medikaments fordert.

Failure of incentive to investigation in infantile pharmaceutical trials has lead to insufficient supply with drugs within pediatrics and child- and adolescent psychiatry in Germany. In prac- tice, drugs that are approved for adults are used to treat minors as a remedy. In many areas such "off label use" has become the medical standard and is therefore owed by the doctor under medical malpractice law. The principle of economy, that rules the law of public health insurance, forbids the prescription of drugs, that are not tested. However, as minors have the right to equal protection, the principle of economy can not prohibit off label use to the detriment of minors. By virtue of the European orphan drug direction we can expect an improvement of drug supply in the field of pediatrics and child- and adolescent psychiatry in the long run. But meanwhile it would be unethical and unlawful to deny minors through restrictions on drug prescription a standard treatment, where the medical standard demands off label use of a pharmaceutical product.
