Abstract / Description
Die vorliegende Arbeit vergleicht die Landesgesetze von Baden-Württemberg,
Hamburg, Hessen und Niedersachsen zum Jugendstrafvollzug am Maßstab
verfassungrechtlicher und internationalrechtlicher Vorgaben. Zugleich
werden die behandelten Ländergesetze innerhalb der Regelungspunkte untereinander auf ihre Eignung verglichen. Auslöser für die Behandlung
des Themas war die Entscheidung des BVerfG vom 31. Mai 2006, in welcher das BVerfG den Jugendstrafvollzug in Deutschland mangels hinreichender
gesetzlicher Grundlage als verfassungswidrig deklarierte. Um diesen
Missstand zu beheben, gab das BVerfG den Gesetzgebungsorganen der Länder auf, bis zum Ablauf des Jahres 2007 verfassungskonforme
Jugendstrafvollzugsgesetze zu schaffen.
Die Arbeit selbst ist aufgrund der besonderen Aktualität der vorliegenden
Materie von einer Vielzahl maßgeblicher Änderungen und Umbrüche des
Prüfungsgegenstandes mit Blick auf die untersuchten
Jugendstrafvollzugsgesetze, namentlich Baden-Württembergs, Hamburgs,
Hessens und Niedersachsens geprägt.
The present study compares the laws of Baden-Wuerttemberg, Hamburg, Hessen and Lower Saxony to the youth enforement on scale constitutional and international legal requirements. At the same time the treated laws and their rules are compared with each other for their suitability. Trigger for the treatment of the subject was the decision of the Constitutional Court of 31 May 2006, in which the Constitutional Court declared the juvenile prison in Germany as unconstitutional because of lack of sufficient legal basis. To improve this situation, the Federal Constitutional Court mandated the legislative bodies of countries to establish constitutional juvenile prison laws by the end of 2007.
Due to the particular relevance of this matter, the paper itself is marked
by a number of significant changes according to the different juvenile
prison laws of Baden-Wuerttemberg, Hamburg, Hessen and Lower Saxony.
